About Work Breaks in the United States
Break requirements in the United States vary significantly by state. While federal law (FLSA) doesn't require employers to provide breaks, many states have enacted their own break laws:
- States requiring meal breaks: California, Colorado, Connecticut, Delaware, Illinois, Kentucky, Maine, Massachusetts, Minnesota, Nebraska, Nevada, New Hampshire, New York, North Dakota, Oregon, Rhode Island, Tennessee, Vermont, Washington, West Virginia
- States requiring rest breaks: California, Colorado, Kentucky, Minnesota, Nevada, Oregon, Vermont, Washington
- No break requirements: Some states have no laws mandating breaks for adult workers
Common Break Practices
- Rest breaks: Typically 10-15 minutes, paid, every 4 hours
- Meal breaks: Usually 30-60 minutes, unpaid, for shifts over 5-6 hours
- Split shifts: May require additional compensation or break time
Important Considerations
- Short breaks (5-20 min) are typically paid under FLSA
- Meal breaks must allow employee to be completely relieved of duties to be unpaid
- Industry-specific rules may apply (e.g., healthcare, transportation)
- Union contracts often specify break requirements
