Understanding Bereavement Leave in the U.S.
Federal Law
There is no federal law in the United States requiring private employers to provide bereavement leave. The Family and Medical Leave Act (FMLA) does not cover bereavement. This means bereavement leave policies are determined at the state level or by individual employers.
Typical Policies
Most employers offer 3-5 days paid bereavement leave for immediate family members (spouse, parent, child) and 1-3 days for extended family. Many employers allow employees to use PTO or unpaid leave for additional time off.
